To be considered as a protectable plant variety it is necessary that on its obtaining process, genetic improvement knowledge has been applied.
Plant varieties are not patentable. However, legal protection is granted since the breeder's certificate issuance for a twenty years period in some cases and twenty-five years in others.
As the rest of exclusivity rights granted by the Intellectual Property, the issuance of breeder's certificate allows the holder to prevent thirds from exploiting the variety without authorization.
